1. General Terms and Conditions

The General Terms and Conditions of the online shop www.leny.eu have been drawn up in accordance with the Consumer Protection Act, on the basis of the recommendations of the Slovenian Chamber of Commerce and Industry and the international e-commerce codes. The order binds the seller and the buyer and has the character of a contract. Orders and invoices are kept in printed and electronic form in the archives at the headquarters of our company Gomstar d.o.o., Zavrh pod Šmarno gora 12A,
1211 Ljubljana Šmartno. The invoice is sent to the customer together with the order, and a copy of the order is sent electronically upon order confirmation.
The contract/order shall be concluded in the Slovene language. When placing an order in the online shop www.leny.eu, the visitor becomes a customer and enters personal data (e-mail address, first name, last name, address, place of residence, telephone number) that unambiguously identify and link the customer to the order.
We reserve the right to withdraw from the execution of an order, in part or in full, if the product ordered is currently out of stock or is not available in a particular material or colour. In this case, we will inform you by e-mail or telephone of the missing products and agree on the delivery or termination of the contract (order).
2. Ordering method
You can order goods from our online shop 24 hours a day. By clicking on the ‘Confirm Order’ button, you confirm that you have read the full text of the terms and conditions of sale and payment set out here and that these terms and conditions were expressly brought to your attention at the time of purchase. Your confirmed order will be automatically forwarded to your e-mail address. Notifications of order completion and any other events related to your order are always sent to your e-mail address.

Your order will be automatically forwarded to the email address you provided when you placed your order. The electronic order placed or the purchase contract concluded is stored at the company’s headquarters.
At the consumer’s request, a copy of the order will be sent to the e-mail address or physical address indicated in the order.
3. Prices
All prices in the shop are in euros (€) and include value added tax (VAT). Prices are valid at the time the order is placed. We reserve the right to change prices without prior notice. The contract of sale between the supplier and the buyer is concluded from the moment the buyer confirms the order. All prices and other fixed terms and conditions shall apply to both the Buyer and the Seller from that moment.
4. Delivery and method of payment
The normal delivery price for the area within Slovenia is 5,90 € and within EU is 6,90 € and. In the case of a large order, the delivery price is subject to change and is clearly indicated in the ordering process before the order is finalised. We use the Slovenian Post for delivery.
When shopping in our online shop www.leny.eu we offer four payment options:
- Cash on delivery: you pay the amount of your order to the postal employee upon delivery of the parcel. You do not have to pay the postage fee, as it is covered by Gomstar d.o.o..
- Pre-payment: you pay the amount of the order into our bank account. The way you do it (via bank, post, online bank, etc.) is not important. We will send you all the information necessary to make the transfer in a confirmation e-mail. We will dispatch the parcel once we have received the transfer.
- PayPal: After completing the payment, you will be redirected back to the www.leny.eu sub-page of the online shop, where you will see information about the success of the payment and the completion of the order. To use the PayPal payment system, you must have a PayPal account.
- Leny shop pick-up: You can pick up your products during opening hours in our Leny shop. We offer the possibility to pay by cash and bank cards.
You choose your preferred payment method during the order process.
5. Delivery time
Goods ordered in stock and from the standard offer shall be dispatched within three (3) working days. For other goods, the delivery time is stated separately on the product information page.
6. Right of withdrawal, return of goods
In the case of distance contracts (ordering via the online shop www.leny.eu), the Buyer has the right to notify the Company in writing or by e-mail within fourteen (14) days that he/she wishes to withdraw from the contract, without being required to give a reason for his/her decision. The time limit for exercising the right of return shall start to run from the day on which the Buyer receives the goods. The products must be returned to the company within 30 days of the withdrawal notice. The returned products must be undamaged, in unaltered condition, unworn, untreated, with the original labels and in their original packaging. The only cost to be borne by the buyer in connection with the withdrawal is the direct cost of returning the goods (e.g. postage). We do not accept ransom items or items for which the addressee has to pay postage.
If the Buyer discovers that the Products are damaged, defective, in the wrong quantity or colour on delivery, the Buyer may withdraw from the order. After prior agreement with us, the damaged goods with all the related contents of the package shall be sent to our address within 14 days of receipt of the shipment. In this case, the shipping costs will be borne by Gomstar d.o.o. No other method of return is possible at our expense. We do not accept parcels with ransom and parcels for which the addressee has to pay the postage.
The Seller shall not be liable for any damage caused by the delivery of the product. The buyer must report any damage to the delivery service.
The Seller shall not be liable for any damage caused by improper use or maintenance of the Products.
In all cases of complaint, we will refund the purchase price within 30 days of receipt of the complaint. A copy of the original invoice and a written explanation of the reason for the refund must be attached. If the complaint is found to be justified, the product will be replaced and sent to the buyer at the seller’s expense.
The Consumer Protection Act expressly states in Article 43c(5)(2) that the consumer does not have the right of withdrawal: in the case of contracts for goods which have been manufactured according to the consumer’s precise instructions and which have been tailored to the consumer’s personal needs.
An example of such a product is a pair of trousers that have been cut short according to the buyer’s instructions.
7. Protection of personal data
Gomstar d.o.o., Zavrh pod Šmarno gora 12A, 1211 Ljubljana Šmartno, the operator of the online shop www.leny.eu, is obliged to protect the personal data of its users in accordance with the Personal Data Protection Act.
For the purposes of operating the online shop www.leny.eu, Gomstar d.o.o. collects the following user data:
- name and surname
- address and place of residence
- e-mail address
- telephone number
- The operator of the online shop www.leny.eu will not pass on the user’s data to unauthorised persons under any circumstances. Only the user’s delivery address will be entrusted to a delivery service (e.g. Post of Slovenia).
We will only send notifications of new products (e-newsletters) by e-mail if the user has chosen this option or has subscribed to it. We will only use your telephone number if there is a need to contact you as soon as possible in connection with your order.
Exceptional disclosure of personal data
The data collected and processed by the administrator of the online shop www.leny.eu will only be disclosed if such an obligation is provided for by law, or in the good faith belief that such action is necessary for legal proceedings before a court or other public authorities, or for the protection and pursuit of the legitimate interests of Gomstar d.o.o..

8. Dispute resolution
The Seller and the Buyer will resolve disputes amicably. If no mutual agreement can be reached, the court in Ljubljana shall have jurisdiction to settle disputes.
